This is a representative constitutional petition filed in Kenya by our client, Daniel Motaung. He has sued Meta and Samasource. The case seeks changes in the working conditions of Facebook content moderators key of which is the provision of adequate psychosocial support considering the harmful nature of content moderation work. We also seek damages for violation of constitutional rights such as violation of the right to freedom of association and to fair labour practices.
Meta has challenged the jurisdiction of the Kenyan Employment and Labour Court to hear this case. The ruling on this constitutional challenge will be delivered in February 2023.
